BROWN PAPER BAG COMPETITION

1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

2. Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter and its agencies associated with this competition are ineligible to enter.

3. To enter register your details online at www.tedcreated.com.au in accordance with the instructions during the Entry Period. Register for the competition to gain access to the blank template and specifications, supplied as an eps and/or psd file. Create a design for the brown paper longneck bag shown on the website. Your design must incorporate the number ‘696’. Submit your completed design either online to: ted696@tedcreated.com.au , or by post to : TED696 Project, PO Box 20727, World Square Sydney NSW Australia 2002. Submissions by email should be a maximum file size of 5mb. All submissions should be at a minimum of 150dpi with dimensions 668 pixels x 2160 pixels (115mm x 375mm). Digital art can be sent in either psd, tif, pdf, eps or jpg formats. A second copy of the design should also be sent in jpg format shown on a brown paper bag as part of the artwork to ted696@tedcreated.com.au (to be published on the site) (this is preferred to help us display design entries online and is not a condition of entry). Please do not send the hi-res version, but keep the highest resolution file in case you are selected as a finalist. No purchase of Promoter product is necessary to enter. Entries received after 23.59 AEST on 01/06/08 will not be accepted.

All valid entries that are deemed acceptable by the Promoter will be posted onto www.tedcreated.com.au during the Entry Period. Each entrant consents to the Promoter using their entry and registered details for the purpose of the www.tedcreated.com.au website and for any related competition or promotional purposes, including (but not limited to) use for the popular choice voting competition by users of the website and as part of public exhibitions of works submitted into the competition.

4. The competition commences at 00.01 AEST on 04/04/08 and closes at 23.59 AEST on 01/06/08 (“Entry Period”).

5. This competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based on creativity. Multiple entries per entrant are permitted however each design can only be submitted once.

The winners selection will be performed in 2 ways:
i. The Judges Vote, a board of design professionals; and
ii. The Public Online Vote, including the weekly winner and overall People’s Choice Award, the general public.

6. Judges Vote: Judging will take place from 02/06/08 to 13/06/08, with the 10 shortlist finalists judged by 09/06/08. Entries will be judged by a panel of leading international designers/design community selected by the Promoter. The judging panel will select the 10 best entries as the finalists in the competition. The entry judged the best out of the 10 finalists will be the overall prize winner. The selected designs of the 10 finalists, including the overall prize winner, plus a selection of the best works submitted into the competition, will be exhibited at the MTV Gallery in Sydney on 13/06/08. The judging panel reserves the right not to choose any of the entries as the winner if none are found suitable or eligible in accordance with these conditions.

Public Online Vote: The winner of the weekly public online vote is determined by the number of positive and negative votes lodged for each validly submitted design by the general public online each week from 00.01 AEST on 05/05/08 to 23.59 AEST on 07/06/08 (“Voting Period”). Acceptable entries into the TED 696 Design Competition received during a week of the Entry Period will be posted on www.tedcreated.com.au for the subsequent week and open to public vote each Tuesday. For the first week of voting during the Voting Period, all valid design entries received from the opening of the Entry Period to 23:59 AEST on 04/05/08 will be shown for voting by the public. Visitors to www.tedcreated.com.au during the Voting Period may make 1 positive and 1 negative vote each day per brown paper bag design entered in the TED 696 Design Competition and shown on www.tedcreated.com.au during the relevant voting week. The voting is capped on a weekly basis. The competition entrant with the most positive votes at the end of each week during the Voting Period will receive a prize. The competition entrant with the next highest number of positive votes for that voting week (after the weekly winner) will be named as that week’s runner-up.

In addition, each weekly winner and runner up will be included in a shortlist (total of 10) for the People’s Choice Award upon completion of the Voting Period. This shortlist will be posted on www.tedcreated.com.au following completion of the Voting Period and, from this shortlist an overall People’s Choice Award winner will be determined by a new public vote between 00.01 AEST on 09/06/08 and 23.59 AEST 11/06/08.

Voting to determine each weekly winner will be monitored independently by a computerised voting system. In the event of two or more competition entrants receiving the same number of votes in any voting week, the winner and runner-up for that week will be determined by a panel of qualified judges selected by the Promoter based on the originality and merits of the two entries. At the start of each new voting week during the Entry Period, the voting counters will be reset giving each design entrant an equal chance of winning the voters choice prize in the following week of the Entry Period.

7. The total prize pool will consist of:
Judges Vote: Prize for each of the 10 finalists consists of 2 cases of TED 696 valued at approx RRP $90.00 and a spot in the exhibition at the MTV Gallery in Sydney on 13/06/08. In addition to the finalists prizes, the overall prize winner will receive a signed framed copy of the official brown paper bags and a MacBook Pro 15” 2.4GHz/2X1GB/200GB/SuperDrive valued at approx RRP $3,000 and Creative Suite Standard 3.0 valued at approx RRP $2,000. Total RRP of Judges Vote prize = $5,900.

Public Online Vote: Prize for each of the 5 weekly public vote winners consists of 1 case of TED 696 valued at approx RRP $45.00. In addition to the weekly prize, the overall People’s Choice Award winner will receive a signed framed copy of the official brown paper bags, two cases of TED 696 valued approx RRP $90.00 and a spot in the exhibition at the MTV Gallery in Sydney on 13/06/08 alongside the official 10 finalists.

Total RRP value of all prizes approx $6,215.00. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner.

8. Prizes are not transferable and are not redeemable for cash. The judges’ decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.

9. In the event that any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.

10. Judges Vote: The 10 shortlist finalists will be notified by email on 09/06/08 and the overall prize winner’s name will be announced at the MTV exhibition on 13/06/08 and published on www.tedcreated.com.au.

Public Online Vote: Each weekly public vote winner and runner-up will be notified by email and published on the website each week on 13/05/08, 20/05/08, 27/05/08, 03/06/08 and 9/06/08. The overall People’s Choice Award winner will be notified by email on 12/06/08 and the winner’s name will be published on the website.

11. Participants agree to provide accurate and complete information as may be requested to register for and participate in this competition. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry into or participation in this competition. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this competition. It is a condition of finalists and the overall prize winner receiving their prize that they provide valid proof of identification and age to verify that they comply with the terms and conditions of this competition.

12. The Promoter shall not be liable for any loss, damage or injury suffered (even if caused by negligence) as a result of accepting and/or using a prize, except for any liability which cannot be excluded by law.

13. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify cancel, terminate or suspend the competition and/or disqualify any person who it reasonably suspects is involved in anyway in interfering or tampering with the competition (including voting).

14. By submitting any material for the purpose of this competition, entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Entrants confirm that no other party has any rights in any design they submit for this competition other than the entrant itself (including the entrant’s employer).

15. By participating, entrants agree that ownership of any intellectual property rights in their entry are assigned to the Promoter at no further cost to the Promoter (except as set out in this clause). The entrant agrees to sign any further documentation required by the Promoter to give effect to this assignment. To the extent permitted by applicable law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in any materials submitted as part of their entry and waive all moral rights in such materials. Each entrant confirms and promises that their acceptance of these conditions of entry does not breach any arrangements or contracts they have with any other person (for example, employers). Each entrant indemnifies the Promoter against any claims by a third party that results from a breach of the warranty in this clause.

16. Not withstanding clause 15, should the Promoter wish to use the winning entry of the Judges’ Vote for application across packaging or communication for Tooheys Extra Dry outside of the “TED 696 Project” campaign (consisting of TED 696 Project website and related promotional and public relations activities with respect to the TED 696 Project), the Promoter will notify the relevant designer (overall winner of the Judges Vote) and in good faith, pay to the design owner, a once off amount of $2,000 at the first usage of the chosen design for such wider applications. No further payment will be due if this design is used more than once post the first wider application. Otherwise, the Promoter’s use of any entry submitted for this competition for the TED 696 Project will be at no further cost.

17. Entrants acknowledge and agree that the Promoter may at any time at its absolute discretion remove or modify any material submitted for this competition from www.tedcreated.com.au. This includes (without limitation) any material which (in the sole opinion of the Promoter) is:
(a) defamatory;
(b) violates laws regarding harassment, discrimination, privacy or contempt;
(c) intentionally false or misleading;
(d) an infringement of third party intellectual property rights including copyright;
(e) abusive or offensive, including obscenity, blasphemy and racial vilification;
(f) of nuisance value, inappropriate, off topic or vexatious;
(g) compromising to the privacy of any competitor or other person by containing inappropriate personal information;
(h) seeking to endorse third party commercial products or activities or to advertise or solicit businesses or any third party;
(i) a deliberate provocation of a section of the community;
(j) encouraging persons to misuse drugs or alcohol or engage in any illegal acts, including by exhibit images of excess alcohol consumption or its effects: or
(k) potentially appeal to those under the legal drinking age of 18yrs.

The promoter is not responsible or liable in any manner for any content or materials posted on www.tedcreated.com.au in relation to this competition, or the conduct of any entrants or third parties in relation to materials posted on www.tedcreated.com.au for this competition.

18. Subject to these terms and conditions, entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a finalist or a prize winner in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting products manufactured, distributed, and/or supplied by the Promoter.

19. Entries remain the property of the Promoter. Details from entries will be collected and used for the purposes of conducting this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for promotional purposes surrounding this competition. By entering this competition entrants consent to the use of their information as described in these terms and conditions and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on (02) 9320 2200 during office hours.
